Office of the Ch. 13 Trustee Insurance Claim PoliciesInformation for Insurance Companies:For privacy reasons, we cannot communicate with you directly, so any communications should be through the debtor and his/her attorney, if any.
Please note the following:
1. This office does not hold title to the debtor’s vehicles – titles are held by the creditor with a lien (“lien holder”), and will be released only by those creditors. Even debts included “in the plan” cannot be paid through this office to guarantee title. Those funds will need to be paid to the lien holder directly. Any funds received from you will be presumed to be funds in excess of the payoff, and applied accordingly.
2. The debtor’s attorney has access to our website which will allow him/her to provide you with our payoff figure, but please be advised that some lien holders may provide you with a different payoff figure than that calculated per our website. The debtor’s attorney should be able to explain to his/her client the possible reasons why the payoff from this office may differ from the payoff from the lien holder, and to help the client to decide whether to pursue a course of action to require the lien holder to accept a lower payoff in return for the title.
3. The bankruptcy court’s approval of the settlement of this matter may be required. The debtor’s attorney will be able to advise their client whether an application will be needed.
4. Any funds above the amount needed to pay off the lien should be forwarded to this office, to the payment address of:
